Terms of Use

These Terms of Use ("Terms") govern your use of the Divly iOS application ("Divly", "the app"). By downloading, installing, or using Divly, you agree to these Terms. If you do not agree, please do not use the app.

Divly is distributed through the Apple App Store and is also subject to the Apple Standard EULA. In the event of a conflict between these Terms and the Apple Standard EULA, the Apple Standard EULA governs to the extent of the conflict.

1. The service

Divly is an iOS app that helps you track and split shared expenses with other people. The app can be used without an account (guest mode) or with an optional account that enables syncing of shared groups across devices and between members.

2. Eligibility and accounts

You must be old enough to form a binding contract in your jurisdiction and old enough to use the Apple App Store. If you create an account, you are responsible for the accuracy of the information you provide and for activity under your account. You agree to keep your credentials secure.

3. Acceptable use

You agree not to:

  • Use the app to store or share content that is unlawful, harmful, or infringing.
  • Attempt to access, probe, or interfere with the backend, other users' accounts, or shared groups you have not been invited to.
  • Reverse engineer, decompile, or tamper with the app, except to the extent such restriction is prohibited by applicable law.
  • Use the app to abuse, harass, defraud, or mislead others, including when recording settlements with them.
  • Automate or scrape the app or its backend in a way that degrades the service.

Divly is a convenience tool for splitting expenses between people who have agreed to share them. It does not create, guarantee, or enforce any legal or financial obligation between users. All settlements happen outside the app.

4. Premium subscriptions

Divly offers an optional Premium tier through an in-app auto-renewable subscription. Premium unlocks features such as unlimited groups, receipt scanning, iCloud backup, spending statistics, recurring expenses, percentage splits, the home-screen widget, and CSV export.

Offerings

  • Weekly Premium — billed once per week.
  • Yearly Premium — billed once per year.

Pricing

Prices are displayed in-app before purchase and may vary by region and App Store storefront. Taxes and local fees may apply as determined by Apple.

Billing and auto-renewal

  • Payment is charged to your Apple Account at confirmation of purchase.
  • Your subscription automatically renews for the same period at the then-current price unless you cancel it at least 24 hours before the end of the current period.
  • Your Apple Account will be charged for renewal within 24 hours before the current period ends.

Managing or cancelling

You can manage or cancel your subscription at any time in your Apple Account subscription settings on your device: Settings → [your name] → Subscriptions. Cancellation takes effect at the end of the current billing period; you will keep Premium access until then.

Restoring purchases

If you reinstall Divly or use a new device signed in with the same Apple Account, you can restore an active subscription from inside the app (for example, via the "Restore Purchases" button on the Premium screen).

Refunds

Refunds for purchases made through the App Store are handled by Apple in accordance with Apple's policies. You can request a refund at reportaproblem.apple.com. Where applicable law grants you additional cancellation or refund rights, those rights are preserved.

5. Third-party services

Divly relies on third-party services to operate, including Apple (Sign in with Apple, Push Notifications, StoreKit, iCloud), Supabase (authentication and database), PostHog (anonymous product analytics), and ExchangeRate-API (public currency rates). Your use of Divly is also subject to the applicable terms of those providers.

6. Intellectual property

Divly, its name, the app, its design, and its content (excluding content you submit) are owned by Divly or its licensors and are protected by applicable intellectual-property laws. You are granted a personal, non-exclusive, non-transferable, revocable license to use the app for its intended purpose, consistent with these Terms and the Apple Standard EULA.

7. Your content

You retain ownership of the content you create in Divly (group names, expenses, notes, etc.). By using the app in signed-in mode, you grant us a limited license to store, transmit, and display that content to the members of the groups you choose to share it with, solely for the purpose of operating the service.

8. Availability and changes

We may modify, suspend, or discontinue all or part of the app, including Premium features, with or without notice. We may also change these Terms to reflect new features, legal requirements, or business changes. When we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice in the app.

9. Disclaimer

Divly is provided "as is" and "as available" without warranties of any kind, express or implied, to the maximum extent permitted by applicable law. We do not warrant that the app will be uninterrupted, error-free, or that any calculations or settlements are accurate for your specific situation. You are responsible for verifying any amounts before acting on them.

10. Limitation of liability

To the maximum extent permitted by applicable law, Divly and its contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the app. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Termination

You may stop using Divly at any time by uninstalling it. We may suspend or terminate your access to account-based features if you violate these Terms or use the service in a way that harms other users or the service. You can request deletion of your account data as described in our Privacy Policy.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which the operator of Divly is established, without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection rights that apply to you where you live.
